Introduction 

These terms and conditions explain how you are allowed to use the Hiscox Business Accelerator Portal (the portal) and the operation of this portal by Hiscox Underwriting Ltd, Hiscox Insurance Company Limited and Hiscox Syndicates Limited (Hiscox).

By accessing any part of this portal you will be deemed to have accepted in full these terms and conditions and the terms of the privacy policy. If you do not agree with them, you must not use the portal. You are also responsible for ensuring that all persons who access the portal through your internet connection are aware of these terms and conditions and comply with them.

The purpose of this portal is to connect you with selected third party business services suppliers (the third party suppliers), each of which have agreed to have its details shared on the portal.

These terms and conditions may be different to those on other Hiscox websites. Please take time to review these terms and conditions carefully. 

Please note that Hiscox is merely providing a portal through which you can request the services provided by the third party suppliers. Hiscox does not endorse nor vet the advice given by such third party suppliers and any engagement between you and the third party suppliers is entered into at your own risk and shall be governed by the relevant terms of such third party suppliers. 

You are responsible for deciding whether the products or services of the third party suppliers are suitable for your purposes.

Hiscox does not accept any liability for any services or goods provided by the third party suppliers or for their website content and does not give or enter into any conditions, warranties or other terms or representations in relation to any of these. 

All copyright and other intellectual property rights in any material (including text, photographs and other images and sound) contained in this portal is either owned by Hiscox or has been licensed to Hiscox by the rights owner(s) (for example, by the third party suppliers). You are only allowed to use this portal and the material contained in the portal as set out below. Your access to the portal 

You acknowledge that this portal is currently in a pilot phase and as such is subject to change based on user feedback and operational requirements (among other things). Unless we notify you of a different date, you acknowledge that your access to this portal is due to expire at the end of September 2018.

You may access any part of the portal for which access has been granted to you as part of the pilot process. You will be provided with a password in order to access the portal during the pilot. 

You may only access the portal if you have a valid password. You must treat you password, other log in details and the content of the portal as confidential and must not disclose it or allow access to a third party.

Following the end of the pilot phase you may be asked for feedback on the portal, services and goods accessed via the portal and/or the third party suppliers, as applicable, which shall be used to enable Hiscox to provide a public version of the portal in future. You acknowledge that providing such feedback does not grant you any rights, whether moral or otherwise, with regards to the final version of the portal.

What you are allowed to do

You may print off one copy only of any individual page for your own personal use, as long as you do not do any of the things set out under ‘What you are not allowed to do’ is set out below.

Do not rely on information on the portal

The content on the portal is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the portal.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on the portal is accurate, complete or up-to-date. 

What you are not allowed to do

Unless indicated otherwise as belonging to the third party suppliers, all data, information, text, images and layout on the portal are the exclusive property of Hiscox and must not be emailed, networked, shared, republished, reproduced, transferred or copied (other than for reasonable personal professional use e.g. audit trails or backups). All copyright intellectual and other property rights shall continue to be held by Hiscox and no rights of any kind shall pass. Any attempt to damage the portal or act in contravention of these terms and conditions may give rise to legal redress and Hiscox reserves the right to seek damages from such perpetrator.

Changes to terms and conditions

Hiscox may change the terms and conditions from time to time. Please check these terms and conditions each time you use the portal to ensure you understand the terms and conditions that apply at the time of such use.  By browsing this portal you accept the current terms and conditions. You should check these each time you revisit the portal.

Changes to/operation of the portal

Hiscox may change the format and content of this portal or the identity of the third party suppliers presented on this portal in its sole discretion from time to time. The third party suppliers may change the type and nature of the products or services offered via this portal at any time.

Hiscox may suspend the operation of this portal for support or maintenance work, for content updates or for any other reason.

Hiscox reserves the right to stop access to this portal at any time and without notice prior to the end of the pilot phase.

Exclusions of liability

Hiscox excludes all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law. Hiscox accept no liability for any losses or damages which are not reasonably foreseeable arising out of or in connection with these terms and conditions or your use of the portal.

Hiscox shall not be liable to you for any (i) indirect, special or consequential loss; or (ii) loss of profits, loss of turnover, savings, business opportunities or damage to goodwill (in each case whether direct or indirect). 

If any provision of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Nothing in these terms and conditions shall exclude or limit Hiscox’s liability for personal injury or death caused by our negligence or for fraud. In addition, these terms and conditions shall not limit or exclude any other liability that Hiscox are not permitted to limit or exclude under applicable law.

Data protection

We will only use your personal details in line with our privacy policy. Please read this carefully before proceeding. 

By providing your personal details to any third party supplier you are consenting to its use in accordance with the privacy policies of the third party suppliers.

 We will try to resolve your complaint straight away. However, if it requires a more in-depth investigation, then we will aim to give you our final response within eight weeks. If for whatever reason this is not possible, we will contact you to explain the reasons why and let you know how long our investigations are likely to take.

If your complaint relates to the products or services received from a third party supplier then this complaint should be raised with that specific third party supplier directly in accordance with the relevant terms and conditions of that third party supplier.

Jurisdiction

This portal is only for those who have specifically been invited to use it and is only intended for UK residents and businesses only.

These terms and conditions are governed by and are to be interpreted in accordance with English law and in the event of any dispute arising in relation to these terms and conditions the English courts will have exclusive jurisdiction over such dispute.
